With help of mr. Kenneth we found the problem if anybody else need it. On the handler page one must specify the temp file upload directory also, not just in the main file.

my understanding though is that the file is locked for editing not for viewing.uploading the file need only view rights so why can't I upload a file that is only locked for edit? will this functionality ever be part of your control? 

I get it in both Firefox 3 and IE 7. If I upload a small file (less than 200MB) it works perfectly. The strange thing is that the point where it breaks is never the same - usually though it's somewhere between 300-400.
